1. Introduction

Welcome to Pulau Songsong. By accessing our website, making a booking, or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding with any transaction.

2. Definitions

• "Company", "We", "Us", "Our" refers to Pulau Songsong Tourism Sdn Bhd.
• "You", "Your", "Customer" refers to the person using our services or making a booking.
• "Services" refers to tour packages, boat rentals, accommodations, and any other services offered.
• "Booking" refers to a confirmed reservation for our services.
• "Website" refers to pulausongsong.my and all associated pages.

3. Booking and Payment

3.1 Booking Confirmation

A booking is considered confirmed only after:

• You have completed the booking form
• Payment has been received in full or deposit paid
• You have received a confirmation email with your booking number

3.2 Payment Terms

• A deposit of 50% is required to confirm your booking
• Full payment is due 30 days before departure
• Bookings made within 30 days require full payment at time of booking
• Payments can be made via credit card, bank transfer, or online payment gateway

3.3 Pricing

All prices are in Malaysian Ringgit (RM) and are subject to 6% SST (Service Tax) where applicable. Prices may change without notice, but once a booking is confirmed, the price is guaranteed.

4. Customer Responsibilities

4.1 Accuracy of Information

You are responsible for providing accurate and complete information when making a booking. The company is not liable for issues arising from incorrect information provided by you.

4.2 Travel Documents

You are responsible for ensuring you have valid passports, visas, and any other required travel documents. We recommend checking requirements well in advance of your travel date.

4.3 Health and Fitness

You must be in adequate health to participate in tours. Some activities have age, weight, or fitness restrictions. Please inform us of any medical conditions or special requirements at the time of booking.

4.4 Conduct

You agree to behave respectfully towards staff, other guests, and the environment. The company reserves the right to remove any guest whose behavior is disruptive or dangerous, without refund.

5. Company Responsibilities

5.1 Service Delivery

We commit to delivering services as described in our package details. However, we reserve the right to modify itineraries due to weather conditions, safety concerns, or unforeseen circumstances.

5.2 Safety

We prioritize your safety. All activities are conducted with certified guides and proper safety equipment. You must follow all safety instructions provided by our staff.

5.3 Communication

We will keep you informed of any changes to your booking via email or phone. Please ensure your contact details are current.

6. Cancellation and Refunds

Our cancellation policy is detailed in our separate Cancellation Policy which is incorporated into these terms by reference. Please review it carefully.

6.1 Cancellation by Customer

You may cancel your booking at any time. Refund amounts depend on when you cancel, as outlined in our Cancellation Policy.

6.2 Cancellation by Company

We reserve the right to cancel any tour due to insufficient participants, weather conditions, or other reasons. In such cases, you will receive a full refund or the option to reschedule.

7. Limitation of Liability

7.1 Assumption of Risk

You acknowledge that some activities involve inherent risks. By participating, you assume these risks and agree that the company's liability is limited as set forth herein.

7.2 Maximum Liability

To the maximum extent permitted by law, our liability shall be limited to the total amount paid for your booking. We shall not be liable for any indirect, incidental, or consequential damages.

7.3 Third-Party Services

We are not responsible for services provided by third parties (hotels, airlines, etc.) even if arranged through us. Your contract is with those providers directly.

8. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Pulau Songsong and protected by copyright laws. You may not reproduce, distribute, or create derivative works without our written consent.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

10. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the modified terms.
